Informativa in materia di protezione dei dati personali

Ai sensi e per gli effetti del Reg. UE 2016/679 forniamo alcune informazioni relative al trattamento dei Suoi Dati Personali, non solo per ottemperare agli obblighi di legge, ma anche perché la trasparenza e la correttezza sono parte fondante della nostra attività in seno al GDPR 679/2016.

che i dati verranno trattati in accordo alle disposizioni legislative della normativa sopra richiamata e degli obblighi di riservatezza ivi previsti secondo i principi di correttezza, liceità, trasparenza e di tutela della Sua riservatezza.

Base giuridica

L’elaborazione dei dati del cliente si basa sul consenso fornito direttamente dallo stesso, tramite iscrizione al sito, registrazione manuale e iscrizione alla newsletter. L’elaborazione si rende necessaria e per consentire la conclusione del contratto di servizio, o con l’uso o la consultazione del presente sito da parte di visitatori e utenti che approvano esplicitamente la presente informativa privacy e acconsentono al trattamento dei loro dati personali in relazione alle modalità e alle finalità di seguito descritte, compreso l’eventuale diffusione a terzi se necessaria per l’erogazione di un servizio.

Finalità del trattamento:

  • Dare seguito alle attività di presales e di informazione commerciale richieste dal soggetto
  • Gestire, concludere e dare esecuzione del rapporto contrattuale concordato, incluso ogni adempimento relativo ad obblighi fiscali e di contabilità;
  • Gestire ed eseguire le richieste di contatto dell’interessato, le richieste di fornitura dei servizi, nelle richieste di assistenza anche mediante comunicazione a terzi;
  • Dati derivanti da implicita trasmissione nell’uso dei protocolli di comunicazione di Internet, attraverso elaborazioni per permettere di identificare gli utenti, indirizzi IP o i nomi a dominio dei computer utilizzati dagli utenti che si connettono al sito, incluso l’orario della richiesta, il metodo utilizzato nel sottoporre la richiesta al server, la dimensione del file ottenuto in risposta. Ambito territoriale

Il Titolare informa che effettuerà il trattamento dei dati conferiti, prevalentemente in via diretta o attraverso incarico ad altro soggetto. Tale soggetto incaricato ad espletare unicamente attività di data processor potrà essere, in via secondaria, di ambito extra Europeo in particolare di territorialità e diritto Svizzero.

L’interessato

ai sensi dell’articolo 15 del Regolamento EU 679/2016 ha diritto di ottenere la conferma dell’esistenza o meno di dati che la riguardano, ottenere l’indicazione dell’origine e delle finalità e modalità del trattamento, l’aggiornamento, la rettificazione, l’integrazione dei dati, la cancellazione dei dati trattati in violazione di legge e ha diritto di opporsi al trattamento per finalità di invio di materiale pubblicitario.

Accesso ai dati – portabilità

Hai il diritto di richiedere copie di dati personali che ci hai fornito in un formato strutturato, comunemente usato e leggibile elettronicamente, e/o richiederci di trasmettere tali informazioni a un altro fornitore di servizi (laddove tecnicamente fattibile).

Durate del trattamento conservazione

  • In generale, Mowgli AG conserva i tuoi dati personali brevi periodi di tempo, o per il tempo necessario all’esecuzione del contratto stipulato.
  • Potremmo conservare alcuni dei tuoi dati personali nella misura necessaria ad assolvere ai nostri obblighi legali e fiscali nonché alla tutela dei nostri interessi contrattuali.
  • Eccezionalmente potremmo conservare alcuni dei tuoi dati personali per lo svolgimento di attività di indagine, come previsto dalla normativa.
  • Dichiariamo che, trascorsi 24 mesi dal termine delle obbligazioni contrattuali o delle attività di presales e commerciali richieste, rimuoveremo i dati personali non diversamente necessari per normative cogenti.

Ritiro del consenso e limitazione del trattamento dei dati personali

È possibile in qualsiasi momento revocare il consenso al trattamento dei dati personali inviandoci una comunicazione nella quale specifichi la volontà di voler revocare il consenso, oppure procedere direttamente con la disiscrizione ove previsto.
La revoca del consenso non incide sulla legittimità di qualunque attività di trattamento basata su di esso prima della sua revoca.

that the data will be processed in accordance with the legislative provisions of the aforementioned regulation and the confidentiality obligations provided for therein according to the principles of correctness, lawfulness, transparency and protection of your privacy.

Legal basis

The processing of customer data is based on the consent provided directly by the same, through registration on the site, manual registration and newsletter subscription. Purpose of the processing:

  • To follow up the presales and commercial information activities requested by the subject
  • Manage, conclude and execute the agreed contractual relationship, including any fulfilment related to tax and accounting;
  • Manage and execute the contact requests of the interested party, requests for the supply of services, in requests for assistance also through communication to third parties;
  • Data deriving from implicit transmission in the use of Internet communication protocols, through processing to allow identification of users, IP addresses or domain names of the computers used by users who connect to the site, including the time of the request, the method used in submitting the request to the server, the size of the file obtained in response. This data is collected in an exclusively aggregated form to verify the correct functioning of the site, and for security reasons used for the sole purpose of obtaining anonymous statistical information on the use of the site or for technical reasons of correct functioning;
  • The data could also be used to ascertain responsibility in case of hypothetical computer crimes against the IT structure (legitimate interests of the owner);

Territorial area

The Data Controller hereby informs you that it will process the data provided, mainly directly or through assignment to another party. This person in charge of carrying out only data processor activities may be, secondarily, of a non-European scope, in particular of territoriality and Swiss law.

The interested party

Pursuant to Article 15 of EU Regulation 679/2016 has the right to obtain confirmation of the existence or not of data concerning him, obtain an indication of the origin and purposes and methods of treatment, updating, rectification, integration of data, cancellation of data processed in violation of the law and has the right to object to the processing to send advertising material.

Duration of the storage treatment

  • In general, M&S Global Investments SA keeps your personal data short periods, or for the time necessary to execute the contract entered into.
  • We may retain some of your personal data to the extent necessary to fulfil our legal and tax obligations as well as to protect our contractual interests.
  • Exceptionally, we may keep some of your personal data for carrying out investigative activities, as required by law.
  • We declare that, after 24 months from the end of the contractual obligations or the required pre-sales and commercial activities, we will remove the personal data not otherwise necessary for binding regulations.

Withdrawal of consent and limitation of the processing of personal data

It is possible at any time to revoke the consent to the processing of personal data by sending us communication where you specify the will to withdraw the consent, or proceed directly with the unsubscription where required.
